行政复议应诉工作情况汇报今天，省、市政府法制办一行来扶余就行政复议应诉工作进行调研，我代表县政府对各位的到来表示欢迎和感谢。下面，按照省、市政府法制办的通知要求，把扶余县三年来的行政复议应诉工作情况汇报如下。一、基本情况和主要做法近年来，我县十分重视发挥行政复议作为行政层级监督手段的重要作用，认真履行复议职责，促进了依法行政。特别是随着《行政复议法》的颁布实施，我县行政复议应诉工作进入了一个快速发展阶段，具体表现为：行政复议案件数量明显增加，涉及领域日益多样化，办案质量稳步提高，复议权威逐步确立，社会影响面不断扩大。20xx年，我县收到行政复议申请10件，受理9件；20xx年收到复议申请13件，受理了11件；20xx年1—5月份，收到复议申请4件，受理了4件；20xx年我县各级政府部门法制机构共参与各类行政诉讼案件20件，20xx年26件，20xx年1—5月份14件。因不服行政复议决定而提起行政诉讼的案件为9件，未经行政复议程序直接提起行政诉讼的案件为51件；经法院审理，原具体行政行为被撤销的为10件，被法院撤销的这10件，都是没有经过行政复议程序的具体行政行为。三年来，我们通过行政复议工作纠正了乡镇政府、县政府职能部门一批违法或不当的具体行政行为，规范了执法部门的执法行为，提高了执法人员的法律意识和执法水平，维护了行政管理相对人的合法权益，赢得了申请人的信赖和称赞，得到了被申请人的理解、配合和支持。主要做法:。
我们在开展政府法制工作中感到，很多群众甚至包括不少行政机关的工作人员对《行政复议法》和行政复议制度还很不了解，要想尽快打开行政复议工作的新局面，就要在宣传上下大功夫，花大气力。为此,我们把宣传工作做为拓展行政复议应诉工作的重要手段。
一是注重发挥领导学法的示范效应。几年来，每年4月29日，《行政复议法》颁布实施纪念日，县政府分管法制工作的领导都要发表电视讲话，宣传《行政复议法》。同时县委中心学习组还将《行政复议法》列为领导干部学法内容，通过领导带头学习来带动全社会学好用好这部法律。
二是经常开展社会性常规法律宣传。我们感到，单靠一两次宣传活动是远远不够的，更多的要靠一定时期内的反复宣传。三年来，我们年年将《行政复议法》列为全县公民的普法内容，充分利用电视、报刊、广播等多种渠道，广泛宣讲行政复议基本知识，做到了让行政机关和行政相对人都了解和运用这部法律。
三是突出宣传的针对性。针对部分行政管理相对人想申请行政复议，又担心费用问题的心理，我们有针对性地讲解行政复议不收取申请人任何费用的法律规定，消除申请人的担心。对行政复议工作中发现的部分执法单位执法不规范甚至违法的情形，我们认真进行了分析整改，在执法人员培训班上以案说法，增强了宣传工作的现实针对性。
四是硬化宣传措施。为使宣传工作落到实处，不流于形式，我县实行行政复议、法律学习、执行情况“三挂钩”制度。即与公务员年度学法考核挂钩，与行政执法证件办理挂钩，与对执法部门的执法评议挂钩，促使各单位都重视这部法律的宣传和学习。
开展行政复议应诉工作，行政复议应诉工作队伍的建设至关重要。我县这几年按照“政治强、业务精、纪律严、作风正”的要求，精心打造了一支特别有战斗力的行政复议应诉人员队伍。
第一，健全了行政复议领导机制。一是高度重视行政复议机构建设。我县充分认识到行政复议工作对于推动全县依法行政的深入开展，转变机关作风，塑造高效、公正、廉洁政府新形象的重要意义。把行政复议机构建设摆上重要位置。从20xx年开始，县政府就选拔了一批行政复议工作的业务骨干，将政府办的法制科确定为政府法制办公室，定为正科级建制，健全了复议工作机构。同时，在县财政十分困难的情况下，行政复议工作所需经费、车辆，由县政府办统一解决，保证正常复议工作有充足的经费保障。二是建立健全了行政复议案件领导层层把关机制。行政复议决定的作出，要经过法制办——分管副主任——主任——分管副县长这样一个工作流程，实行领导层层审查把关。通过这种机制，使政府行政复议机构规格高，影响力强，加强了政府对行政复议工作的领导力度。三是高度重视和支持行政复议工作。县政府常务副县长定期听取行政复议工作汇报，帮助解决工作中的一些实际问题。比如，有一起行政复议案件，具体行政行为被撤销并责令限期重新处理，但执法单位迟迟未执行复议决定，县政府领导亲自督办落实。
第二，配齐配强行政复议工作人员。在行政复议人员配备上，我们坚持高标准、高起点。20xx年开始，从县司法局、后备干部中各选调一名政治素质高、事业心强、业务能力强的大学本科毕业的年轻干部到县政府法制办公室工作。我县的行政复议工作人员配备做到了有责任、懂业务、懂行政管理，这样的人员结构配置很好地适应了行政复议工作的现实需要。
第三，提高复议人员的政治素质。行政复议工作既清苦又辛苦，同时责任大、任务重。因此，加强对复议人员的政治思想教育，提高其政治素质必不可少。我们主要抓了“三项教育”。一是宗旨教育。采取谈心、座谈等方式沟通交流思想，深入开展行政复议工作艰巨性、光荣性教育，引导复议人员牢固树立法律意识、责任意识、服务意识；二是勤政教育。面对相对艰苦的条件，在行政复议人员中大力倡导无私奉献、爱岗敬业的奉献精神。用奉献精神激励调动复议人员的工作热情和积极性。《行政复议法》规定行政复议原则上采取书面审查的办法，但实际上资源权属类的复议案件，往往案情复杂，复议机关不到实地调查，根本无法真正掌握案情，作出准确裁决。碰上这类案件，我们要求每起案件都要进行现场调查取证。三是廉政教育。行政复议机构是一个清水衙门，但也可能发生利用手中的复议权力捞取好处的事情。为此，我们在案件审查的各个环节，规定复议机构和复议人员不得向当事人索取和收受当事人馈送的财物，不接受当事人的吃请，坚决杜绝了不给好处不办事，给了好处乱办事现象的发生。
第四，加强行政复议人员业务学习。要对基层和部门的各类执法行为实施有效监督，自己就得成为这一领域的“行家里手”。我们十分注重抓好复议人员自身的业务学习，刻苦钻研，练好“内功”。一是鼓励自学；二是积极组织参加上级部门举办的各类法制培训班；三是经常就一些典型疑难案件，与政府法律顾问及法院、检察院的专业人员讨论、交流；四是虚心求教。对一些拿不准的问题，主动向上级业务部门请教。在办理资源权属行政复议案件时，法制办就曾多次向省水利厅、林业厅和省、市法制办进行咨询。
缺乏公正的行政复议，不但有损于法律的尊严，而且会冷却行政管理相对人通过行政复议寻求救济的热情，损害政府权威和形象，行政复议也无法真正有效地开展下去。申请人来申请复议，本身就存在疑虑，担心行政复议机关会“官官相护”。我们用自己的实际行动，较好地体现了复议机关办案的公正性，树立了行政复议的权威。
一是严格依法受理复议案件。凡符合受案条件的行政复议申请，不管申请人是什么身份，也不管被申请人属哪个部门，法制办都依法受理。碰上申请人未提交书面复议申请或申请书写不规范的，工作人员会帮助其代写、修改或将其口头复议申请作书面记录，依法保障申请人的复议申请权。
二是平等对待双方当事人。在复议过程中，任何一方均没有特权，双方都享有平等的复议权利，承担相应的复议义务。考虑到行政管理相对人的弱势地位，在行政复议中，我们更加突出对相对人合法权益的保护及对行政权力的监督。比如申请人的申请权、委托代理人权、陈述权、申辩权、查阅权、撤回复议申请权，我们均十分注意予以保障。而对被申请人，我们更多地是要求其履行法定义务，从而尽可能地平衡双方在行政管理中的不对称关系。
三是公正裁决。在案件审理中，坚持不办人情案、关系案，以事实和法律作为定案的唯一客观标准，切实做到了该维持的维持，该撤销的撤销，该变更的变更。近三年来，作出撤销和变更决定的有5件，指出被申请人错误，被申请人自行撤销原处理，取得申请人谅解而撤回行政复议申请的有6件。在行政复议中，对原具体行政行为审查要求适当从严，维护了法律平等性，也进一步推动了执法单位的依法行政水平。

二是建章立制。为确保办案质量，我县先后建立了复议案件主办人制，复议案件评查制，错案责任追究制。复议案件受理后，由领导分派案件，明确主办人，主办人须对复议案件具体办理承担主要责任；年终组成评查小组，对复议案件办理情况进行评查；行政复议案件办理如果出现质量问题，则严肃追究有关人员的责任。
三是突出复议审查重点。在审查具体行政行为证据是否确凿、充分，看案件主要事实是否查清。我们要求被申请人必须在法定期限内提交当初作出具体行政行为的所有证据材料，事后搜集的材料，不能用于证明原具体行政行为成立。各方提交的证据材料必须同时具备真实性、合法性、关联性。凡不同时具有“三性”的材料，不能作为定案的依据，尤其是案件中的主要证据更是如此。在证据采信过程中，要求复议人员谨慎、负责，对证据进行详细论证。在审查具体行政行为法律适用是否准确、全面，看其法律基础是否可靠。在审查具体行政行为是否符合法定程序，是否损害或剥夺申请人的程序权利。针对执法机关普遍存在重实体、轻程序的倾向，我县在复议中做到实体与程序并重，强调程序的重要性，突出对执法单位办案程序的监督。
几年来，我们在行政复议案件办理中，严把质量关。所办结的案件，当事人总体上还是满意的，大多数人都能够自觉履行复议决定。少数当事人不服行政复议，又向人民法院提起行政诉讼的，人民法院都支持了复议机关的意见。迄今为止，尚未出现复议决定被推翻的现象，较好地维护了复议机关的权威性。二、存在的问题。
我县的行政复议应诉工作有了一个良好的开端，在推进全县依法行政、化解行政争议、维护社会稳定方面发挥了积极作用。但在实际工作中也面临不少困难和问题。一是复议案件数量增加与行政复议人员队伍建设之间的矛盾比较突出。随着行政相对人法律意识的增强，我县行政复议案件数量正呈逐年上升的趋势，并且涉及土地、林业、水利、牧业、公安等方面的案件上升速度最快。但行政复议队伍的人员数量、业务素质、知识结构相对滞后，人员较少，业务素质偏低、知识结构单一，法律专业毕业的人才很难留在县一级，这种人才资源不足与案件数量增加之间的矛盾正日益突显；二是行政复议机构的地位偏弱，职能偏软，待遇偏低，可供选择的强有力的监督手段偏少；三是行政复议工作具体措施还不多，一部分行政机关重视程度不够，造成许多问题常常不能得到及时处理，行政效率有待于进一步提高，行政复议工作机制还需要在探索中不断完善。四是行政复议的救济渠道仍然不够畅通。行政相对人对《行政复议法》和行政复议救济渠道了解不多，仍然认为是“官官相护”，相对人选择到法院进行司法救济的行政诉讼案件数量大大超过行政复议案件数量。行政复议总体法制环境还有待于进一步改善，行政机关和行政管理相对人的行政复议意识还有待于不断增强。三、几点建议一是要进一步加大对《行政复议法》和行政复议制度的宣传。改变以往的宣传重点，建议由对行政机关宣传的多，对群众宣传的少向两者都加强的方向转变；由宣传形式比较传统和单一向宣传形式多元化方向转变；由注重法律宣传向法律与案例宣传相结合的方向转变；由时段性宣传向经常性宣传转变。二是要进一步加强队伍建设，提高复议人员素质。行政复议人员工作人员水平高低，直接影响行政复议工作的开展，也直接影响今后行政复议工作的发展。必须要提高行政复议人员素质，以适应新形势发展的需要。加强对行政复议人员的培训。复议人员要掌握党和国家的路线、方针、政策，又要了解政府各部门的行政管理业务，既要学好实体法，又要掌握程序法；要加强交流，针对不同时期行政复议案件的不同特点，省、市法制办要多举办一些行政复议案件研讨会，进行专项讨论，公布一些典型案件和行政复议决定，使各地各部门复议机构工作办案时有所借鉴；要实行行政复议人员资格认证，对行政复议人员的资格进行统一的认定和管理，把好行政复议人员的资格准入关，并研究解决行政复议人员的岗位津贴问题。三是要改革复议案件审理方式。在审查形式上，建议将书面审查原则改为公开审查原则，逐步推行听证制度，以增加复议案件办理的透明度，促成一些影响大、涉及面宽、群众关注的复议案件得到妥善解决。这样，不仅有利于密切政府与群众关系，树立政府良好形象，维护政府权威，而且案件审查过程的公开，也可以保障复议裁决公正，扩大行政复议的影响力。原创四是要积极探索新的举措和方法，创新行政复议模式。建议建立全省范围的电子信息行政复议受理平台，为行政相对人提供更方便快捷的申请渠道，通过电子信息行政复议受理平台的建立，实现快捷申请、透明审理、公开结果的现代行政复议管理模式，有效地对行政复议的有关数据进行搜集、积累、分析、比较、归纳、推理和统计，实现省、市、县行政复议资源的共享总之，我县行政复议应诉工作正在朝着好的方向发展，虽然有一些差距和不足，我们会以此为动力，以“三个代表”重要思想为指导，与时俱进，开拓创新，不断开创我县行政复议应诉工作新局面，为全面推进依法行政作出不懈的努力。《原创》comprehensive coordination ability, writing ability, supervision ability, logistics ability, innovation ability, continuously consolidate and maintain the education on Party membersadvancement activities and enhance awareness of the Communist Youth League education achievements, and vigorously promote the construction of civilization advanced units, units and staff home building activities, balanced, focused, pragmatic, innovation, high standard, high quality, high level, high efficiency to complete various tasks throughout the year.First, pay close attention to research information, efforts to improve decision—making servicesIn accordance with the "information reflect the information, promote the work of information leading work" requirements, adhere to grasp the team construction, mechanism construction and quantitative assessment, give full play to the assistant role of leadership, actively promote the innovation of research information development, and vigorously promote the research work of information to mention upgrading, efforts to improve the ability and level of decision—making.(a) adhere to the decision in the first place.
